As a valued stakeholder, the Ministry of Government and Consumer Services is seeking your input on the first phase of proposed regulations to support the implementation of the Condominium Act, 1998 (Condominium Act) as amended by the Protecting Condominium Owners Act, 2015 (PCOA).

The PCOA, which received Royal Assent on December 3, 2015, makes substantial amendments to the Condominium Act and also enacts the Condominium Management Services Act, 2015 (“CMSA”). Proposed regulations to support the implementation of the CMSA were made available for public comment on December 16, 2016 until February 24, 2017.

The proposed regulatory changes under the Condominium Act are focused on improving how condominiums are governed and strengthening the transparency and accountability of condo boards. The proposal incorporates input that was received during an open and collaborative public engagement process that the ministry undertook from 2012-2014 as a part of the Condominium Act Review, as well as from additional input received since then.

The ministry is aiming to have many of these regulatory changes come into force on July 1, 2017, and the remainder in fall 2017.

Information about the proposed regulatory changes, including more details about proposed in-force dates, is now posted on Ontario’s Regulatory Registry for public feedback and consultation for a 45-day period. The posting on the Registry includes a summary of the key elements of the proposed changes. A draft of the proposed regulation will also be posted on the Registry as soon as it becomes available. We will notify you by email when the consultation draft is posted.

The Registry allows members of the public to participate in developing regulations by providing comments on proposed regulatory changes. The ministry will be taking the feedback it receives into consideration when bringing forward the final regulation for approval.

The ministry is working on the development of future phases of regulation amendments to support the implementation of the PCOA, including improving the condo purchasing process, improving condo finances and additional condominium governance matters. The province will continue to consult with members of the public and stakeholders to gather their feedback and expertise during the development of regulations and implementation of this important legislation.
